This document establishes the terms and conditions for the use of this website and the conditions for the purchase of products and services sold through this website (hereinafter referred to as “Terms and Conditions”) in relation to natural persons who access this website, referred to below BUYER.

The use of the site, logging in and access to the services offered represent your acceptance of the privacy terms and conditions detailed below, with all the consequences arising from their acceptance.

The BUYER will have permanent access to the Terms and Conditions for the use of the website to be able to consult them at any time.

If you do not agree with these conditions, we ask you not to use our website.

The SELLER, SC TEXEMBIS SRL reserves the right to update and/or revise the Terms and Conditions at any time without prior notification, that is why we ask you to periodically follow any changes.

By accepting the Terms and Conditions on this page, you express your consent to receive communications or offers for commercial purposes from SC TEXEMBIS SRL through the website www.naturatex.eu. The personal data provided will be processed according to the personal data processing policy. You can unsubscribe at any time from receiving these e-mails by accessing the unsubscribe link at the bottom of the e-mails received or by marking the e-mail as spam or by sending an e-mail to US with the subject unsubscribe.

The information published on www.naturatex.eu belongs to the site, therefore, this information cannot be published, transmitted, copied by any method without the prior written consent of the legal representative of the SC TEXEMBIS SRL company that administers the site. Placing, registering and confirming an order

By placing an order (electronically or by phone) through the online store, the buyer agrees to the form of communication through which the seller carries out your operations (electronically or by phone).

An order consists of the following:

– goods or services found in the offer of the store www.naturatex.eu;

– clear mentions regarding invoicing, delivery dates as well as other special mentions;

– the buyer’s specifications.

Placing an order does not imply an automatic confirmation of the order and the contract.

The complete steps are as follows:

– registration of an order that will lead to the generation of a unique number automatically for each registered order;

– taking an order within the working hours displayed on the website in the Contact section;

– the conclusion of the contract representing the moment of issuing the fiscal invoice on durable or electronic support;

– the delivery of an order is made after confirming the order and after establishing the delivery details specified at the address;

The messages sent automatically by the system do not confirm the existence of the product in stock, nor the conclusion of the Sale-Purchase contract.

Orders are taken/registered only if the product is in stock, in the case of made-to-order products, they will be confirmed later.

The products on offer can only be sold on the basis of an order.

An unconfirmed order does not imply a reservation of the products.

Orders will be honored in the chronological order in which they were registered in the system. An order containing products displayed on the website with the following status: “Unavailable”, “In stock supplier” or “On order” can only be honored after those in stock.

The price and delivery of the products

Product prices and stock are updated every 48 hours to 5 days.

Proformas with included prices are valid for 3 days from the date of their issue.

If prices or other product details have been displayed incorrectly, we reserve the right to CANCEL orders containing these products and notify customers as soon as possible of the error.

For products that are brought on a special order basis, an advance payment of at least 35% of the product value can be requested based on a proforma issued and which must be paid within 24 hours.

SC EMBIS ARTA SRL through the website www.naturatex.eu will deliver the products on the territory of Romania.

Delivery times apply from the moment of order confirmation when all order details have been validated (payment method, payment term), excluding non-working days and can vary from 1 to 30 days.

All the information/methods used to describe the products on the website do not represent a contractual obligation on the part of the Seller, they are used exclusively for the purpose of presentation, delivery, stocks, prices.

Products are available while stocks last.

Booking and picking up products directly from the work point is not a remote order.

For orders exceeding 2000 lei, it is possible to request an advance payment of at least 50% of the order value, payment to be made by bank transfer.

In the case of parcels delivered and arrived at their destination, with damaged packaging (traces of impact, tears, cracks, contact with liquids) or suspicion of non-conformity, it is recommended and insisted on checking the product/products as well as the accessories in the presence of the courier agent as and drawing up a verification process in which any non-conformities are recorded or the package is refused.

The reception of parcels or products that show traces of non-conformities without following the www.naturatex.eu indications is carried out by the customer assuming responsibility.

In the case of orders with pickup directly from the work point, the customer has the obligation to check the integrity of the packaging as well as the product and accessories in the presence of the sales agent in the space delimited for testing (sample bench). In the situation where any non-conformity is noticed, refuse the reception the product.

Any subsequent claim regarding the integrity of the product, accessories or packaging will not be taken into account!

The transfer of risk is carried out according to G.O. 34/2014:

In the case of contracts where the professional delivers the products to the consumer, the risk of loss or damage to the products is transferred to the consumer when he or a third party designated by him, other than the carrier, takes physical possession of the products. However, the risk is transferred to the consumer at the time of delivery of the products to the carrier, if the carrier was commissioned by the consumer to transport the products, and this option was not offered by the professional, without prejudice to the rights of the consumer vis-à-vis the carrier.

Cancellation and return of products

If you are not completely satisfied with a product purchased from www.naturatex.eu, you can return it within 14 calendar days from the time of delivery or collection.

SC TEXEMBIS SRL through the website www.naturatex.eu does not assume responsibility for printing or display errors regarding the prices, characteristics or images of the products.

If an order cannot be fulfilled due to such errors, www.naturatex.eu reserves the right to cancel that order without prior notice.

The www.naturatex.eu team makes every effort to provide correct information about the price and features of the products.

The seller reserves the right to cancel the order, without any subsequent obligation of either party to the other or without any party being able to claim damages/interests from the other, in the following situations, but not limited to:

• the prices displayed on the website www.naturatex.eu are the result of an error
• the ordered product/products are no longer in stock;
• the transaction was not accepted by the bank issuing the Buyer’s card;
• the data provided by the Buyer on the website are incomplete and/or incorrect;

The return of products by the online BUYER is subject to the laws in force as well as its own return policy in some cases.

Shipping costs for returned products will be borne by the BUYER.

The SELLER is responsible for the correctness of the data entered on the transport document (AWB) as well as for the correct packaging and labeling of the parcels.

The parcels sent by the SELLER must be packed in a way that protects the product from the factors that can lead to its damage during the entire transport (it is recommended to use safety elements, e.g.: polystyrene, cardboard, bubble wrap, etc.). It is also recommended to pack the parcel in such a way that it corresponds to the weight, shape and nature of the contents, as well as the mode and duration of the transport.

The packaging must protect the content so that it cannot be damaged by pressure or successive manipulations, and can be, as appropriate, cardboard boxes, plywood, wood, plastic filled with polystyrene.

GUARANTEES

All products are accompanied by an invoice and warranty certificate (manufacturer or seller). Loss of warranty certificate or invoice will result in loss of warranty. Partial or total erasure of the serial number (serial number S/N) on the products leads to the loss of the warranty. We do not issue duplicates for the warranty certificate.

The lack of the warranty certificate of the ordered product must be reported within a maximum of 48 (forty-eight) hours after receiving it at mail@naturatex.eu. Any subsequent submissions will not be considered.

All products sold by www.naturatex.eu, except for resealed ones, benefit from warranty conditions according to the legislation in force and the commercial conditions of manufacturers and distributors – all products are new, in original packaging. The guarantee of the products sold by www.naturatex.eu is provided by SC TEXEMBIS SRL through the return of the products.

Limitation of liability www.naturatex.eu

SC TEXEMBIS SRL uses in the website www.naturatex.eu dedicated software, but also other software that is used within it, are provided in the manner in which they are found and as long as they are available, without any kind of guarantees, express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular use, or non-infringement.

We assume no responsibility for the modification, suspension or interruption of the website www.naturatex.eu, in whole or in part.

SC TEXEMBIS SRL, through the website www.naturatex.eu cannot be responsible for damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations according to the Order and for damages that resulting from the use of the goods after delivery and in particular for their loss.

By creating and using the Account, the customer/buyer assumes responsibility for maintaining the confidentiality of the Account data (user and password) and for managing access to the Account and, to the extent permitted by the legislation in force, is responsible for the activity carried out through his Account.

Also, by creating an account and/or using the Content and/or placing Orders, the customer expressly and unequivocally accepts the Terms and Conditions of the website www.naturatex.eu in the latest updated version that is communicated within the website, existing on the date of creation of the Account and/or use of the content and/or on the date of placing the Order.

SC TEXEMBIS SRL, through the website www.naturatex.eu, reserves the right to periodically update and modify the Terms and Conditions to reflect any changes in the way and conditions of the site’s operation or any changes in legal requirements. The document is enforceable against Clients/Users/Buyers from the moment it is displayed on the website. In the event of any such change, we will display the modified version of the document on the website, so please check the content of this document periodically.

Processing of personal data

Major force

Neither party shall be liable for failure to perform its contractual obligations, if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is the unforeseeable event beyond the control of the parties and which cannot be avoided.

Force majeure will be communicated to you by the competent authorities and publicly communicated.

If, within 15 (fifteen) days from the date of its occurrence, the said event does not cease, each party will have the right to notify the other party of the full termination of the contract without any of them being able to claim other damages to the other.
